FILING YOUR SOCIAL SECURITY DISABILITY CLAIM!

Before you sign up, the Law Offices of William Grover Arnett highly recommends that you first call our office and schedule an appointment to discuss any questions that you may have concerning disability.  Our office can answer your questions thoroughly. If you don’t have a treating physician or a physician who won’t cooperate in completing disability forms, we can refer you to physicians who are specialists in treating social security disability claimants, and understands how to develop your medical evidence in reports that are favorable when your evidence is presented for review. 

Generally speaking, two-thirds of all people who apply for Social Security Disability are denied on their first try. Many of these people are eventually awarded benefits because they hire an attorney who is experienced in handling social security disability claims, and go through the appeals process. Hiring a social security disability attorney during any stage of the benefits claims or appeals process, is your right.

To be eligible for Social Security Disability Insurance Benefits (DIB), you can’t be working, must have a disability either physically or mentally that is expected to last or has lasted 12 months.  You must also meet the earnings status requirements at the time you became disabled. In order to meet the earnings status requirements, you must have been fully insured as well as having worked five years out of the last ten when you became disabled. The concepts of fully insured status and “specially insured” (5 years out of the last 10) can be very complicated but will be reviewed closely by the Law Office of William Grover Arnett when you file your application. 

Now if you haven’t worked long enough to meet the insured earning status requirement for Social Security Disability Insurance Benefits (DIB), you may still be able to sign up for Supplemental Security Income (SSI).   In order to be eligible for Supplemental Security Income (SSI), you must be either:

1.    Over 65 and impoverished or

2.    Disabled and impoverished.

3.    Generally speaking, in most cases if you are eligible for welfare, you are eligible for Supplemental Security Income (SSI). In states without welfare, you must either have no income or income that puts you below the federal poverty level, and little or no redeemable assets.  Also, in some case if you are eligible for Social Security Disability Benefits (DIB) you may also be eligible for Supplementary Security Income (SSI) if your monthly DIB check, which is based on your pay into the system while working, isn’t that great.  The Social Security Administration will determine whether you meet this rule when you first sign up and when you are granted your benefits.

Currently, federal law may allow you to file for your Social Security Disability benefits, but statistics clearly show that claimants who are represented by a social security lawyer such as William Grover Arnett win their claim quicker than claimants who try to represent themselves on their own.

The government makes the process very frustrating, difficult and complicated. The completions of forms are very complicated.  Please remember that Social Security Disability Benefits/SSI are often denied to individuals who have legitimate Disability claims. As a result, there are many people who apply for Social Security Disability/SSI  Benefits on their own, become discouraged and intimidated by the Social Security Disability process.    This causes many claimants to simply give up, and go away even when he or she may genuinely be entitled to Social Security Disability benefits.  The Law Offices of William Grover Arnett does not allow the government to intimidate our social security disability clients.   We take pride in being active, aggressive and well prepared advocates for our clients.
