How Injury Cases Are Valued
People who
have been in an accident must decide whether to make a claim. One factor in making this decision is estimating how much money you may receive for your injury. Here are various kinds of damages that courts recognize in deciding how much money to award:
Medical Expenses: This includes money you spent for treatment as well as the amount estimated for your future medical expenses.
Pain and Suffering: Money can be awarded for the pain and suffering you endure.
Disfigurement and loss of function. Loss of body part or scarring will be compensated.
Income and Earnings: This covers income you lost plus money for a reduced future earning ability.
Property Damage: Damages can be awarded to fix or replace property damaged in the accident, or to reflect its reduced value.
These are just some of the damages that may be awarded. The damages to be received depend on all the ways the injury affects the person involved.
